1. Definitions
In these Terms and Conditions:
"Company", "We", "Us", "Our" refers to Bright Choice Electrical.
"Client", "You", "Your" refers to the user of our website or the recipient of our electrical services.
"Services" refers to all residential, commercial, industrial electrical works, maintenance, repairs, and installations provided by us.
2. Quotes and Estimates
All quotes provided by Bright Choice Electrical are valid for a period of thirty (30) days from the date of issue unless specified otherwise in writing. Quotes are based on the information provided by the Client and a visual inspection of the site where applicable. If unforeseen site complexities, safety hazards, or regulatory non-compliance are discovered during the performance of the work, we reserve the right to amend the quote. The Client will be notified of any variations before additional work commences.
3. Payment Terms
Payment terms will be specified on the invoice provided to the Client. Unless otherwise agreed upon in writing, standard payment terms require full payment immediately upon completion of the work. For larger projects, progressive stage payments may be negotiated. We accept payments via electronic funds transfer (EFT) and major credit cards. Late payments may incur interest charges calculated daily at a rate of 2% per month above the standard index rate, alongside any collection recovery costs incurred by the Company.
4. Australian Consumer Law and Guarantees
Our Services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). For major failures with the service, you are entitled to cancel your service contract with us and receive a refund for the unused portion, or compensation for its reduced value. You are also entitled to choose a refund or replacement for major failures with goods. All workmanship provided by Bright Choice Electrical carries a statutory warranty period in alignment with state building and electrical regulations.
5. Site Access and Safety
The Client must ensure that our licensed electricians have clear, safe, and unhindered access to the work site at the scheduled time. If access is restricted or unsafe conditions are encountered (including but not limited to structural instability, hazardous materials like asbestos, or aggressive animals), we reserve the right to suspend work until the issue is rectified by the Client at their own expense.
6. Limitation of Liability
To the maximum extent permitted by law, Bright Choice Electrical shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, revenue, or data, arising out of or in connection with our services or website. Our total liability for any claim arising under these terms shall not exceed the total amount paid by the Client for the specific service provided.
7. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of Australia and the specific state in which the services are rendered. Any disputes arising out of these terms shall be subject to the exclusive jurisdiction of the courts of that state.
